We help users buy, sell, and trade collectibles, provide a platform for sharing insights and discussions, and offer innovative features like our fake detector, all aimed at enhancing your collecting experience.

By accessing or using the hoardboard website or mobile application, you are agreeing to abide by the Terms and Conditions set forth in this document. These Terms and Conditions apply to all visitors, users, and others who access or use our Platform. If you disagree with any part of these terms, please discontinue use of our Platform immediately.

2. User Registration & Account Terms

To access the full features of hoardboard, you will need to create an account. During the registration process, you will be required to provide certain information and you will establish a username and a password.

2.1 Age Restrictions

You must be at least 18 years old to register for an account on hoardboard. By creating an account, you confirm that you are at least 18 years old. If you are under 18, you may not create an account or use hoardboard.

2.2 Account Creation

To create an account, you will need to complete our sign-up form. This involves providing some personal information, including your name, email address, and a password. If you plan to buy or sell items on hoardboard, you will also need to complete an onboarding process with our payment processing partner, Stripe. This will involve providing additional information, such as your payment details.

2.3 Account Termination

You may terminate your account at any time through your account settings. However, if you have any outstanding orders or unmanaged cancellations at the time you wish to terminate your account, you will need to resolve these first. hoardboard reserves the right to suspend or terminate your account at any time and for any reason, including if we believe that you have breached any of these Terms and Conditions.

2.4 User Responsibilities and Obligations

As a user, you are responsible for all activities that occur under your account. You agree to notify hoardboard immediately of any unauthorized use of your account or any other breach of security. hoardboard will not be liable for any loss or damage arising from your failure to comply with this provision.

You agree not to create an account using a false identity or information, or on behalf of someone other than yourself. You agree that you will not have more than one account at any given time. You agree not to create an account or use hoardboard if you have been previously removed by hoardboard, or if you have been previously banned from any of our Platforms.

By agreeing to these Terms and Conditions, you represent that the information you provide to hoardboard upon registration and at all other times will be true, accurate, current, and complete. You also agree to ensure that this information is kept accurate and up-to-date at all times.

3. User-Generated Content

The hoardboard platform allows users to post content, including photos, comments, and other materials. Anything that you post or otherwise make available on hoardboard is referred to as "User Content."

3.1 Ownership of Content

You retain all rights in, and are solely responsible for, the User Content you post to hoardboard. However, by submitting User Content to hoardboard, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, store, display, reproduce, modify, create derivative works, perform, and distribute your User Content on hoardboard solely for the purposes of operating, developing, providing, and using the hoardboard Products. This license is as broad as legally permissible under UK law.

3.2 User Rights and Responsibilities

You are responsible for the User Content that you post. You represent and warrant that you have all necessary rights to the User Content you post; that it complies with all applicable laws and regulations; and that it does not conflict with the rights of third parties. You also agree that your User Content will not contain material that is false, intentionally misleading, or defamatory; violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation.

3.3 Prohibited Content

The following types of content are not allowed on hoardboard:

  • Content that promotes violence or harassment towards others
  • Content that promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
  • Content that infringes upon or violates the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights
  • Content that is defamatory, obscene, pornographic, vulgar or offensive
  • Content that promotes illegal activities or substances
  • We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms and Conditions. Violations may result in immediate account suspension or termination, and in serious cases, we may take further legal action.

4. Privacy & Data Use

At hoardboard, we are committed to respecting and protecting your privacy. This section outlines our practices regarding the collection, storage, and use of your personal data, as well as your rights concerning that data.

4.1 Data Collection, Storage, and Use

When you register for and use hoardboard, we collect and store certain information, such as your name, email address, and other relevant details you provide during the registration process. Your data is stored on our Supabase server, which is hosted on an Amazon server located in Walnut, USA.

We use your data to manage your account, provide you with access to hoardboard services, personalize and enhance your experience, perform internal operations (including fraud prevention), and to comply with legal obligations.

4.2 Cookies and Other Tracking Technologies

We use cookies and similar technologies like pixels, tags, and web beacons to collect log data and device information. This includes using third-party services like Google Analytics and Facebook Pixel to help us understand how our site is being used, track site performance, and make improvements. By using hoardboard, you consent to the use of these technologies.

4.3 Third-Party Data Sharing

While we currently do not share your personal data with third parties for their marketing purposes, we reserve the right to do so in the future. However, any such sharing will be in compliance with applicable data protection laws, and you will be informed of any such sharing in advance.

4.4 User Rights

In accordance with GDPR and other applicable privacy laws, you have certain rights regarding your personal data. These include the right to access your data, the right to rectify incorrect data, the right to erase your data, the right to restrict or object to our processing of your data, and the right to request data portability. 5. E-commerce Transactions

This section outlines the terms related to transactions on hoardboard, including the process, fees, dispute resolution, returns or refunds, taxes, and liability.

5.1 Transaction Process and Fees

When you make a transaction on hoardboard, you are subject to various fees. This includes a 30p transaction fee, a 6.6% platform fee, and a 1.4% Stripe processing fee. These fees help us cover the costs of providing you with our services.

Memberships on hoardboard can reduce the platform fee. However, the Stripe processing fee and the transaction fee are fixed and will not be affected by your membership status.

5.2 Dispute Resolution

In the event of a dispute, users can submit a dispute request on the website or contact hoardboard directly. We will review all evidence provided and aim to resolve the issue as fairly and quickly as possible.

5.3 Return and Refund Policy

Sellers on hoardboard have the discretion to offer refunds to buyers. If a user contacts hoardboard with a dispute, we may issue the refund on behalf of the seller after a thorough investigation. Please note that refunds are issued on a case-by-case basis, and issuance of a refund does not guarantee future refunds under similar circumstances.

5.4 Taxes

The seller is responsible for the payment of any applicable taxes related to transactions made on their account. It is the seller's responsibility to determine what, if any, taxes apply to the payments they make or receive, and it is their responsibility to collect, report, and remit the correct tax to the appropriate tax authority.

5.5 Disclaimer of Liability

hoardboard is not involved in the actual transactions between buyers and sellers and thus is not responsible for any issues arising from these transactions. We do not guarantee the quality, safety, or legality of items advertised, the truth or accuracy of users' content or listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction.

6. Payment Processing

This section outlines the terms related to payment processing on hoardboard, including the use of Stripe and the security measures in place.

6.1 Payment Processing via Stripe

All payments made on hoardboard are processed securely through Stripe, a third-party payment processing platform. Stripe is an industry leader in online payment processing and adheres to strict standards for security, including compliance with the Payment Card Industry Data Security Standard (PCI DSS).

When you make a transaction on hoardboard, your payment details are encrypted and securely transmitted to Stripe. hoardboard does not store your payment card details on our servers. Stripe processes the payment, deducts the transaction fee, and then transfers the remaining amount to the seller's account.

6.2 Security Measures

We take the security of your financial information seriously. As mentioned above, we do not store your payment card details on our servers. Additionally, all communication between hoardboard, our users, and Stripe is encrypted using SSL technology.

Moreover, Stripe is designed to detect and prevent fraudulent transactions. It uses advanced machine learning algorithms to identify patterns of fraud and blocks any suspicious activity.

By using hoardboard, you agree to Stripe's terms of service and privacy policy, and you acknowledge that you have had the opportunity to review them.

7. Intellectual Property Rights

This section outlines the intellectual property rights pertaining to hoardboard's website and mobile app, including content ownership and user rights.

7.1 Ownership of Website/App Content and Trademarks

All content and materials available on hoardboard's website and mobile app, including but not limited to text, graphics, website name, code, images, and logos, are the intellectual property of hoardboard, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by hoardboard.

The hoardboard name, the hoardboard logo, and all related names, logos, product and service names, designs, and slogans are trademarks of hoardboard or its affiliates or licensors. You must not use such marks without the prior written permission of hoardboard. All other names, logos, product and service names, designs, and slogans on this website are the trademarks of their respective owners.

7.2 User Rights Concerning the Website/App Content

As a user of the hoardboard website and mobile app, you are granted a limited license to access and use the site and its content. This license does not include any resale or commercial use of the site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms of Use are reserved and retained by hoardboard or its licensors, suppliers, publishers, rights holders, or other content providers.

You may not use any meta tags or any other "hidden text" utilizing hoardboard's name or trademarks without the express written consent of hoardboard. You may not misuse the hoardboard website or its mobile app. You may use the hoardboard website and mobile app only as permitted by law. The licenses granted by hoardboard terminate if you do not comply with these Terms of Use.

8. Rules of Conduct/Prohibited Actions

  • Creating fake accounts: All accounts must be tied to a genuine person or entity. Creating an account with false information or impersonating another person or entity is strictly forbidden.
  • Scamming: Any form of dishonest behavior aimed at deceiving or defrauding other users is unacceptable. This includes misrepresenting the quality, authenticity, or value of items for sale, as well as failing to deliver items as promised.
  • Selling counterfeit items: All items listed for sale on hoardboard must be authentic. Selling counterfeit or unauthorized replica items is a violation of our terms and can result in immediate account suspension or termination.
  • Other bad practices: This includes any action that violates the law, infringes upon the rights of others, or interferes with the functioning of the website or mobile app.

We actively monitor our platform for such activities and will take appropriate action when needed. This may include removing content, issuing warnings, suspending or terminating accounts, and/or reporting users to law enforcement authorities.

9. Moderation & Content Removal

At hoardboard, we are committed to maintaining a safe and respectful environment that is conducive to positive interaction and fair trading. As part of this commitment, we reserve the right to moderate and remove user content in certain circumstances.

9.1 Moderation

Our team actively monitors content posted on our website and mobile app to ensure it adheres to our community guidelines and rules of conduct. This includes but is not limited to posts, comments, images, and listings.

9.2 Content Removal

We may remove or edit content in the following circumstances:

  • If it violates our community guidelines or rules of conduct, including content that is offensive, discriminatory, harassing, or promotes illegal activities.
  • If it infringes on the intellectual property rights of others.
  • If it contains false, misleading, or deceptive information.
  • If it is deemed inappropriate or irrelevant to our platform.

10. Limitations of Liability & Disclaimers

To the maximum extent permitted by law, in no event shall hoardboard, its affiliates, agents, directors, employees, suppliers or licensors be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, this service.

Under no circumstances will hoardboard be responsible for any damage, loss or injury resulting from hacking, tampering or other unauthorized access or use of the service or your account or the information contained therein.

10.2 Disclaimers

The services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

hoardboard, its affiliates, and its licensors do not warrant that the services will be uninterrupted, error-free, or free of viruses or other harmful components. You use our services at your own discretion and risk.

hoardboard does not warrant the accuracy, completeness, or usefulness of the content provided on the platform. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the website, or by anyone who may be informed of any of its contents.

10.3 Transactions

hoardboard is not involved in the actual transactions between buyers and sellers and is not the agent of sellers for any purpose. As a result, hoardboard has no control over the quality, safety, morality, or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. hoardboard does not pre-screen users or the content or information provided by users.

By using hoardboard, you agree to accept such risks and hoardboard is not responsible for the acts or omissions of users on the website.

11. Termination of Use

11.1 Termination by User

You may terminate your account and end your use of the hoardboard services at any time and for any reason. To do this, please contact our customer service team with a request for account deletion. Please note that any obligations incurred prior to termination, including but not limited to payment obligations, will survive this termination.

11.2 Termination by hoardboard

hoardboard may terminate or suspend your account and access to the services, at its sole discretion, at any time and without prior notice, for any reason, including but not limited to:

  • Violations of these Terms and Conditions or any other policies stipulated by hoardboard.
  • A request by law enforcement or other government agency.
  • Unexpected technical or security issues or problems.
  • Engagement by the user in fraudulent or illegal activities.

Upon termination or suspension, your right to use the services will cease immediately. You agree that we may also deactivate or delete your account and all related information and files in your account and bar access to such information or files. Further, you agree that hoardboard shall not be liable to you or any third party for any termination or suspension of your access to the services or deletion of your account.

11.3 Survival

Upon termination, all rights and obligations will be extinguished, except that such rights and obligations which by their nature are intended to survive termination (including without limitation, all limitations on liability, releases, indemnification obligations, disclaimers of warranties, agreements to arbitrate, choices of law and judicial forum and intellectual property protections and licenses) will survive.

12.3 Acceptance of Changes

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of England and Wales.

13.2 Jurisdiction

The Contract, including non-contractual matters arising from it, will be subject to the jurisdiction of the courts of England and Wales. However, if the Customer is a resident of Scotland or Northern Ireland, they may choose to bring legal proceedings in the courts of their respective region.

At hoardboard, we are committed to providing high-quality service and customer satisfaction. If a dispute occurs, we encourage customers to contact us directly via email to find a resolution. Our aim is to respond to all complaints within a 5-day period with a solution that is satisfactory to all parties involved. We believe that most concerns can be resolved in this way, but if the dispute remains unresolved, it may be necessary to seek a legal resolution.
